История становления международного коммерческого арбитража в Республике Казахстан

Abstract

Мақалада Қазақстан Республикасындағы халықаралық коммерциялық арбитраждың жаңа, балама, инновациялық сот құрылымы ретіндегі қалыптасу жəне даму тарихы қарастырылады. Қазақстан Республикасында төрелік пікірталасу институтының пайда болуы заңды инвестициялық саясат жүргізу жəне нарықтық экономиканы дамыту бағытын таңдаған тəуелсіз Қазақстан алдындағы аса қажетті проблемалармен дəлелденеді. Халықаралық коммерциялық арбитраждың қалыптасу тарихы хронологиялық түрде көрсетіледі. Қазақстандық коммерциялық арбитраж тарихының Қазақстан Республикасындағы халықаралық коммерциялық арбитраж туралы заңдарды тіркеуден бұрынғы жəне одан кейінгі сипаттамасы ұсынылады. Осы мақсатта қазақстандық коммерциялық арбитраждың заң негізі талданады, арбитраждық іс-тəжірибе аймағындағы халықаралық құқықтық бай тəжірибе жинақталып қорытылады, қазіргі Қазақстандағы халықаралық коммерциялық арбитраждың іс- əрекетін жетілдіру жолдары анықталады. In the article the history of the organization and development in the Republic of Kazakstan International Commercial Arbitration as a new, alternative, innovative courts structures are scrutinized. Regularity of the Republic of Kazakhstan Institute of arbitration is confirmed by pressing problems facing the sovereign Kazakhstan, which committed to carry out investment policy and the development of the market economy. History of the formation of international commercial arbitration is presented in chronological order. The article offers characteristic of the Kazakhstan’s arbitration history before and after the ratification the Republic of Kazakhstan’s laws about international commercial arbitration. For this purpose the legislative framework of the Kazakstan International Commercial Arbitration are revealed, the international law extensive experience in the field of the arbitration practice are generalized, the ways of improving the activities of International Commercial Arbitration in modern Kazakstan are identificazed.
