Правовое измерение социальных трансформаций

Abstract

Мақалада қазіргі жаһандану əлеміндегі құқықтың орны мен рөлі туралы айтылады. Сондай-ақ құқықтық дамудың негізгі факторлары, құқықтық жүйенің өзгеру мен өзектілік тəсілдері жəне қазіргі əлеуметтік трансформацияға сəйкестігі талданады. Философиялық, теориялық-құқықтық позиция тұрғысынан құқықтық мəселенің негізгі тəсілдері қарастырылады. Сонымен қатар зерттелетін мəселенің тарихи-философиялық талдауы ұсынылады жəне құқықтың əр түрлі əлеуметтік, мəдени нормативтік құрылымдармен қарым-қатынасы айқындалады. Автордың қорытындылары құқықтық феноменнің аксиологиялық бөлімдерімен нақтыланады.

This article discusses issues related to the comprehension of the place and role of law in the contemporary globalizing world. The main factors of legal development, methods of dynamization and updating the legal system, the achievement of its adequacy to modern social transformations are analyzed. The analysis of the main approaches to the problem of law in terms of philosophical, theoretical and legal positions is carried out. We propose a historical-philosophical analysis of the investigated problem. The forms of interaction of law with different socio-cultural normative formations are considered. The author’s conclusions are determined by specifying the axiological components of the legal phenomenon.
