Abstract

In work discussion about expected insufficiency of democratic legality of the judicial supervision recognizing laws unconstitutional is investigated. At these normative legal acts various functions in the constitutional state. The constitution establishes basic rights and regulates the government. The law is accepted and affirms parliament according to a majority rule. A question in how to settle the democracy understood as «a majority rule», with stability of the political legal system established by the Constitution, remote from political dispute in Parliament. In the constitutional jurisdiction discussion about principles excludes the political arguments applied to belief of the majority. The important role of the Constitutional Court consists in providing bases of a democratic law and order.
