Abstract

Мақала Қазақстан Республикасы конституциялық құндылығындағы атқарушы биліктің мəселелерін зерттеуге арналған. Қазақстан Республикасында атқарушылық билікті конституциялық құндылыққа жатқызуға бола ма? Қазіргі таңда ҚР Конституциясымен бекітілген əлеуметтік құндылықтар иерархиясы мемлекеттің қоғам, халық, жеке адам алдындағы мақсаты мен тапсырмасын шешуде жəне олардың құқықтық бекітілуінде басты жол сілтеуші болып табылады. Олардың қалыптасуының демократиялық қағидаларын бекіту мемлекеттік органдар жүйесін құру мемлекеттің баға жетпес құндылығы бола отырып, адам, оның құқықтары мен бостандықтары əлеуметтік құндылықтар иерархиясында басты орын алатын, қоғамның дамуына жағдай жасаушы құралы болып есептеледі. 1995 жылғы ҚР Конституциясы өзіндік, тəуелсіз, күшті жəне тиімді сапада атқарушылық биліктің барлық қажетті саяси-құқықтық негіздерін қамтиды. Алайда бүгінгі таңда нақты кері тəуекелшілдік- факторлар сақталып отыр. This article is devoted to the study of problems of executive power as constitutional value of the Republic of Kazakhstan. If it is possible to consider the executive branch of power in the Republic of Kazakhstan as accomplished constitutional value. Currently, the hierarchy of established in the Constitution of the Republic of Kazakhstan social values is the main reference point for determining the goals and objectives of the state in relation to society, people, individual and their legal consolidation. Establishment of the system of state bodies and securing democratic principles of their functioning, as the obvious value for the state, it is a means of creating such conditions for society development, when human rights and freedoms occupy the predominant place in the hierarchy of social values. The Constitution of the Republic of Kazakhstan of 1995 contains all the necessary political and legal foundation for the practical construction of executive power as a separate, independent, strong and effective. However, today there are some negative factors-risks.
