Abstract

Мақала «көліктік шарттар» ұғымын анықтау мəселелеріне арналған. Бұл мəселе Қазақстан Республикасының ғана емес, шет мемлекеттердің де заңнамасында бірмағыналы шешімін таппай отыр. Көліктік қатынастарды құқықтық реттеуді жетілдіру «көліктік шарт» ұғымын айқындаумен тығыз байланысты, сондықтан мақалада көліктік шарттардың құқықтық табиғаты зерттелген. Автор қазіргі кезеңдегі көліктік шарттар жүйесін анықтау бойынша ғалымдардың өркениетті құқық іліміндегі бар ғылыми ізденістерін зерттеуге талпыныс жасаған. This article is devoted to the problems of the defining the meaning of transportation contracts. The question of the transport contract meaning in the law didn’t find unequivocal decision not only in the Republic of Kazakhstan but also in foreign countries. Improvement of legal regulation of transport relations is closely connected with the elucidation of the concept of the transport contract, so in the article the legal nature of the transport contracts is studied. The author attempted to examine the existing scientific researches of scientists in the doctrine of civilized law, by defining the system of transportation contracts in the modern period.
